1st Chance Transport - Terms and Conditions
1. By Owner or Agent's signature (hereinafter referred to as Shipper), 1st Chance Transport or its agent's (hereinafter referred to as 1st Chance Transport) is hereby authorized to act as a Liaison between the customer and the DOT authorized, licensed and fully insured transporter, before and during the transport of the vehicle from the point of pickup specified to the point of destination.
2. 1st Chance Transport and Carrier are not licensed or insured to carry household goods or personal items. Absolutely NO personal items can be transported in vehicle(s). Neither 1st Chance Transport nor any of the Carriers we broker to are responsible for damages (either interior or exterior) caused to vehicle(s) by any personal items inside of vehicle(s). Any costs, damages, sit time, or citations issued to Carrier due to or caused by excess weight of personal items in vehicle(s) will be the sole responsibility of the Shipper. Any delay time, fines, bail and/or impound fees will be passed along to Shipper before release of vehicle(s). Absolutely no firearms, alcohol, hazardous material, contraband or illegal substances are allowed in said vehicle. Vehicles are subject to inspection by DOT and/or State Police. Shipper verifies the vehicle(s) is/are free of contents.
3. Once your order has been accepted by 1st Chance Transport, we will make every effort to meet the customer's requested scheduling, no guarantee of pick up or delivery can be made, expressed or implied. Delays may occur due to carrier schedules, mechanical failure, inclement weather and unforeseen circumstances. If the Customer insists on pick up or delivery on a specific date, 1st Chance Transport reserves the right to contract with a local Towing Company to pick up, hold and or deliver the vehicle to meet with the customers requested schedule, and the customer agrees to pay for this additional service at actual cost.
4. 1st Chance Transport does not transport vehicles. It only arranges for the transportation of vehicles by a Carrier. As such, the Shipper agrees to file any and all claims with the Carrier as identified on the Bill of Lading and to bring any and all legal action for damages against the Carrier only. The Shipper releases and holds 1st Chance Transport harmless from any such damage claims. All information concerning carriers selected by 1st Chance Transport including insurance information and United Stated Department of Transportation Authority are on file at 1st Chance Transport and are available to Shipper upon request.
5. If your vehicle is oversized or customized (longer than 16 feet, dual wheels, pickups or vans with campers, racks, high tops, etc.), please inquire to the extra charges. If 1st Chance Transport or Carrier are not advised of inoperable, oversized, or customized vehicles prior to pickup, all extra charges will be added to C.O.D. charges at the time of delivery. An additional fee of up to $300.00 (three hundred dollars) will be added for oversized or customized vehicles.
6. Shipper agrees that should this vehicle become inoperative for any reason during the transport, a charge of up to $150.00 (one hundred and fifty dollars) will be added to the transport charges and will be collected at time of delivery. This charge must be paid along with any balance due in the form of CASH or CASHIER'S CHECK.
7. If, upon attempted notification by phone to Shipper by Carrier, cannot make contact for delivery of vehicle(s); the vehicle(s) will be taken to closest terminal, at the discretion of the Carrier. All C.O.D.'s, terminal fees, storage fees, additional trucking fees, if any, would be due and payable to the Carrier in either cash or cashier's check before release of vehicle(s) to Shipper. Due to varying circumstances, i.e., weight restriction, steep hills, overhanging trees, narrow streets, cul-de-sacs, etc., the Carrier, on a "door-to-door" order, may have to arrange with Shipper to meet him at a legal and safe pick-up or drop-off point as close as possible to the "door" to deliver/receive vehicle(s). Carrier will phone Shipper between 3 and 24 hours prior to pick-up or drop-off of vehicle(s) so that any C.O.D.'s due to truck driver can be prepared. Shipper agrees to make arrangements with Carrier and meet the truck to load and/or unload, at a safe and legal place.
8. 1st Chance Transport shall use its best efforts to arrange a carrier to pick up your car within the scheduled window and deliver it on average, between 10-14 days coast to coast, fewer days on a shorter route.
9. Shipper agrees to allow 1st Chance Transport to act as its agent in dealing with the Carrier, and to exercise its efforts on owners' behalf in placing the order with a Carrier they deem fit. Said Carrier will route vehicle(s) from origin to destination by a suitable route and does not agree to any specific routing or to meet any schedule of Shipper.
10. Shipper understands and agrees that the vehicle order is subject to additional terms and conditions that appear on the Bill of Lading/Condition Report of the assigned Transporter. While 1st Chance Transport, Carrier and its agents are driving the vehicle(s) for purposes of parking, storage and prior to loading/unloading on/off a truck incidental to performance of the obligations under this agreement, 1st Chance Transport, Carrier, and its agents shall have the full benefit of any insurance that has been effected by Shipper on the vehicle.
11. If there is any problem regarding a trucking delivery, any balance due the truck must be paid before a claim can be honored. First, the damage should be properly noted on the delivery receipt (Bill of Lading) while the driver is still there before the balance is paid with cash or cashiers check. Then a copy of the pick up and delivery receipt, 2 estimates for repairs and pictures of the damage should be sent to the Carrier immediately so as to expedite a proper resolve. Payment to the driver or signing of the Bill of Lading at destination without notation of damage, no matter what time of day or night, or type of weather, shall be evidence of satisfactory delivery of vehicle(s). Failure to do so indicates satisfactory delivery and no further claim can/will be honored by Carrier. Shipper warrants that he will pay the price quoted due on the Shipping Order for delivered vehicles, and will not seek to charge back a credit card or stop a check to offset any dispute for damage claims. Department of Transportation regulations require that all claims are filed in writing and all tariffs are paid in full before a claim can be processed.
12. All fees owed on delivery (C.O.D.) must be paid in either CASH or CASHIER'S CHECK only; no other form of payment will be accepted.
13. This agreement supersedes all prior written or oral representation of 1st Chance Transport and constitutes the entire agreement between Shipper and 1st Chance Transport and may not be changed except in writing by an officer of 1st Chance Transport.
14. If any provision or part of this Agreement is held to be invalid or unenforceable, all other parts of this Agreement remain in effect. The laws of the State of Texas shall govern this Agreement. Any legal action against 1st Chance Transport must be filed in the Municipal or Superior Court of Comal County, Texas. BY EXECUTING THIS AGREEMENT, SHIPPER WAIVES ANY AND ALL RIGHTS TO LITIGATE ELSEWHERE. The prevailing party in any litigation initiated under this agreement shall be entitled to reasonable attorney's fees and court costs incurred.
15. Customer agrees that giving his shipping information and/or credit card information to 1st Chance Transport via telephone or fax constitutes a verbal authorization to proceed and all terms and conditions will apply.
16. Customer is free to cancel this order without penalty as long as a transporter has not been assigned and/or no services have been rendered. Customer agrees to pay $100.00 (one hundred dollars) for cancellation after a carrier has been contracted by 1st Chance Transport to transport their vehicle(s).
17. 1st Chance Transport assumes no responsibility for auto rental fees due to delays, damage or accident.
